Scotts obtains summary judgment in suit alleging infringement of potting soil patent

Jones Day defended The Scotts Miracle-Gro Company in the United States District Court for the District of Nevada in a patent infringement case directed to a "growing medium" and a method of producing that growing medium. The patented growing medium is dehydrated and expands upon contact with water, and the patent claims were directed at manufacturing details, namely a particular volume-to-volume ratio to which the growing medium is compressed. The district court granted Scotts motion for summary judgment of noninfringement on January 24, 2014. Jones Day now represents Scotts in appeal to the United States Court of Appeals for the Federal Circuit.
