Empire Today settles independent contractor misclassification class action

Jones Day represented Empire Today, LLC, a national flooring and carpet company, against allegations that it had improperly classified two classes of workers in Massachusetts as independent contractors, rather than employees. The company denied the allegations on the grounds that it had entered independent contractor agreements with independent carpet installation companies, each of which hired its own workers. The federal court enforced the arbitration provision in the contractor agreements and required claims of certain workers to proceed to arbitration; claims of other workers continued in federal court. The case settled prior to discovery.
