Eviction case dismissed

Mr. L.P.'s landlord sued to evict him based on excessive noise; however, there were no particulars provided about the alleged excessive noise. Jones Day filed a Motion to Dismiss on the basis, among others, that the Notice to Quit lacked the required specificity. After the motion was fully briefed, plaintiff's counsel called to say they were dismissing the case with prejudice. More importantly for the client, the landlord agreed that Mr. L.P. was no longer excessively noisy.
