Orange County businessman obtains dismissal with prejudice in criminal case alleging illegal wholesale distribution of prescription medications

Jones Day obtained dismissal of a felony criminal case against a client, an Orange County, CA businessman, involved in the wholesale distribution of prescription medications. During the relevant time, the client was a duly licensed wholesaler of such medications. The government charged the client with multiple felony offenses for alleged illegal resale of the medications. Jones Day's position was that the client's activities were completely lawful. We also raised the threshold issue that the government had illegally kept the indictment against the client under seal for over two years, in violation of his rights. On the client's motion, the court dismissed the entire indictment against the client with prejudice, finding that the lengthy sealing of the charges made the indictment untimely and violated the client's speedy trial rights.
