Jones Day represented an international civil engineering contractor in arbitration proceedings under the HKIAC Rules claiming prolongation costs caused by unforeseen ground conditions. The project involved the construction of a river training scheme in Hong Kong. The main contract included a special condition allocating the risk of significantly worse ground conditions to the project employer. The arbitral award was rendered in favor of the contractor including an award for costs and interest.
