Inmate wrongfully denied outdoor exercise for fourteen months, achieves favorable settlement

Clients Thomas , Otis Michael D57701

Prison officials kept Otis Thomas locked in his cell without any outdoor exercise for a period of fourteen months as a result of prison violence in which Mr. Thomas had no part. The Ninth Circuit Court of Appeals reversed the District Court’s grant of summary judgment in favor of defendants, holding that the denial of such a fundamental human need violated Mr. Thomas’s Eighth Amendment rights as a matter of law. A Jones Day San Francisco team comprised of David Wallach, Anderson Berry, and Nandini Iyer represented Mr. Thomas on remand, and expeditiously achieved a very favorable settlement.
