Inmate wrongfully denied outdoor exercise for fourteen months, achieves favorable settlement

Prison officials kept Otis Thomas locked in his cell without any outdoor exercise for a period of fourteen months as a result of prison violence in which Mr. Thomas had no part. The Ninth Circuit Court of Appeals reversed the District Court’s grant of summary judgment in favor of defendants, holding that the denial of such a fundamental human need violated Mr. Thomas’s Eighth Amendment rights as a matter of law.
