Board of Immigration Appeals upholds grant of withholding of removal

Jones Day represented a gay man, MM, in the Department of Homeland Security’s appeal of a grant of withholding of removal. MM suffered violent attacks and rape in Mexico due to his sexual orientation and fled to the United States. In the deportation hearing, the Immigration Judge granted MM withholding of removal. The Department of Homeland Security appealed the decision and claimed that MM had not been persecuted and could safely relocate in Mexico. After extensive briefing by Jones Day, the Board of Immigration Appeals upheld the Immigration Judge’s finding of past persecution and grant of withholding of removal.
