Ohio Edison wins dismissal of suit

Jones Day successfully represented Ohio Edison, a subsidiary of FirstEnergy Corp., in a suit brought by a property owner before the Public Utilities Commission of Ohio. The suit sought to challenge an injunction obtained by the company to require the property owner to move certain structures that were under the company's transmission line in violation of the National Electric Safety Code and the company's easement. The company filed a motion to dismiss on the grounds that the Commission lacked jurisdiction. The Commission agreed and granted the motion. The property owner's appeal was rejected by the Ohio Supreme Court which affirmed the Commission's decision in a unanimous opinion.
