PLAC files amicus brief in support of Zimmer's appeal from $27.6M jury verdict in Philadelphia Court of Common Pleas

At the request of the Product Liability Advisory Council (PLAC), Jones Day submitted an amicus brief urging the Pennsylvania Superior Court to vacate an excessive jury award. A Philadelphia jury awarded a 71-year-old woman, who submitted no proof of any medical expenses or economic loss, over $27 million for pain and suffering after defendants' alleged negligence caused her to have complications requiring four more surgeries with her knee replacement. Plaintiff is now able to walk only with use of a walker. Comparing the Philadelphia jury's award to other jury awards in Pennsylvania and neighboring states, we argued that the award was demonstrably excessive and should shock the court's conscience.
