Empire Today defends against putative wage and hour class action in California

Jones Day represents Empire Today, LLC in a putative wage and hour class action filed on April 12, 2010 in San Mateo Superior Court. The plaintiff has alleged that Empire violated the California Labor Code in several ways, including by failing to pay all required overtime, not paying for all hours worked, failing to provide accurate wage statements, failing to provide meal periods and rest breaks and similar Labor Code violations. Plaintiff made these allegations on behalf of himself and two putative classes: (1) the allegedly improperly classified installers who signed independent contractor agreements; and (2) workers hired by the allegedly improperly classified installers as laborers.
