Marcus & Millichap Real Estate Investment Services obtains affirmance from Seventh Circuit in commissions dispute with former real-estate sales agent

On March 23, 2011, the U.S. Court of Appeals for the Seventh Circuit affirmed a judgment for Jones Day client Marcus & Millichap Investment Services, Inc. in a commissions dispute with one of the company's former real-estate sales agents. After a week-long trial, the jury found for Marcus & Millichap on all of its counts and awarded it nearly a million dollars. On appeal, the former sales agent raised a host of legal challenges, claiming, among other things, that the trial court made improper evidentiary determinations and that the jury verdict was not supported by sufficient evidence. The Seventh Circuit rejected all of these contentions and affirmed the verdict in its entirety, preserving the judgment for our client.
