Chicago Board of Trade wins summary judgment dismissing predatory pricing claims in antitrust litigation

Eurex, one of the world's leading futures exchanges, filed this complaint against the Chicago Mercantile Exchange and the Chicago Board of Trade, Jones Day's client, alleging that the defendants had conspired to prevent Eurex's start-up futures exchange in Chicago from succeeding. In July 2008, after the briefing was complete on the defendants' motion for summary judgment seeking dismissal of plaintiffs' predatory pricing claims, the plaintiffs dropped those claims.
