Sutter Health affiliate obtains affirmance from Ninth Circuit overturning labor arbitrator's award

Jones Day, on behalf of San Francisco Hospital California Pacific Medical Center ("CPMC"), a Sutter Health affiliate, persuaded a labor arbitrator to reject an SEIU United Healthcare Workers - West grievance. The grievance was the last of five that SEIU had filed challenging closures and staff reductions at St. Luke's Hospital, a struggling inner-city hospital that CPMC acquired in 2006. Despite the high standard for overturning arbitration awards, Jones Day successfully petitioned in federal court to vacate the arbitrator's award. On November 3, 2008, the Ninth Circuit affirmed that the arbitrator's award should be vacated. The decision marked the third consecutive arbitration victory for CPMC over the St. Luke's department closures; the other two grievances previously settled on mutually agreeable terms.
