Verity Instruments mounts successful defense against patent infringement and other claims related to semiconductor wafer inspection and profilometry

Jones Day represented Defendants Verity Instruments, Inc. and its employee successfully against claims including trade secret misappropriation, correction of inventorship, breach of contract, and patent infringement. KLA-Tencor alleged that Defendants had misappropriated trade secrets related to semiconductor wafer inspection and profilometry and incorporated those trade secrets into patents assigned to and technology developed by Verity. KLA-Tencor sought relief including correction of the inventorship of the patents-in-dispute, assignment of those patents to KLA-Tencor, and money damages. Defendants counterclaimed alleging KLA-Tencor's claims were brought in bad faith and without sufficient support in violation of California's UTSA and Federal Rule of Civil Procedure 11. The case settled favorably, with Verity retaining sole ownership of the patents-in-dispute, and no judicial finding of liability or money damages award against either Defendant.
