RE/MAX franchisor defends against tort case arising out of auto accident involving franchisee's sales associate

The plaintiff in this case was severely injured while a passenger in a car operated by a sales associate of Jones Day client RE/MAX International, Inc.'s franchisee. Plaintiff sued the sales associate, his brokerage (the franchisee), and various upstream franchising entities (including RE/MAX) in the Circuit Court of Cook County. Jones Day lawyers obtained summary judgment for RE/MAX International, Inc. In a case of first impression, the Illinois Court of Appeals, First District, affirmed, concluding that the franchisee's sales associate was neither the actual nor the apparent agent of our franchisor client.
