National City settles wage and hour class action challenging the exempt status of its underwriters and wage and hour issues

Jones Day represented National City Bank in a wage and hour class action which challenged the exempt status of its underwriters and asserted related claims for unpaid overtime and other compensation. Jones Day was limited the scope of the case to California even though National City employs underwriters throughout the country. Early in the litigation, the case was mediated, and a favorable settlement was reached in which National City would pay not more than $2.5 million to a class of 200 employees. Potential exposure exceeded $20 million.
