Macy's defends against bankrupt former vendor's putative class action alleging improper expense offsets and discounts

Jones Day represented Macy's Inc. in a putative class action brought by a bankrupt former vendor on behalf of vendors of all of Macy's divisions. The complaint advanced claims under the New York Uniform Commercial Code and sought damages for allegedly improperly applied expense offsets and discounts. In December 2004, the court dismissed certain claims of plaintiffs' and discovery proceeded on class certification issues.
