FleetPride wins commercial arbitration and enforcement of former owner's non-compete agreement

Jones Day represented FleetPride, Inc., a national truck parts company, at a week-long commercial arbitration in which a 5-year, 4-state non-compete agreement was successfully enforced against the former owner of a business acquired by client. After defeating action in Virginia Circuit Court (Roanoke) to enjoin the arbitration and set aside the decision, Jones Day enforced the injunction, shutting down the competing business and obtaining a damage award of $192,000.  Jones Day prevailed before the Virginia Supreme Court, which refused to enjoin arbitration proceedings.
