Cole National challenges California restrictions on business and financial relationships between opticians and optometrist or ophthalmologist

Jones Day represented Cole National Corporation, a provider of optical products and services, and two of its subsidiaries in a challenge to a California regulation imposing limits on business and financial relationships between opticians and optometrists or ophthalmologists. The Attorney General of California brought suit charging that two Cole subsidiaries, Pearle Vision, Inc. (which provides optician services) and Pearle VisionCare, Inc. (a health care service plan providing optometric services) were in violation of California laws that restrict relationships between opticians and optometrists. After an adverse decision in a California appellate court, Jones Day appellate attorneys took the lead in successfully petitioning for review by the California Supreme Court and in arguing the matter for Cole National in that court.
