CareerBuilder successfully resolves FLSA collective action

Jones Day represented CareerBuilder, LLC in a parallel U.S. Department of Labor investigation and FLSA collective action alleging that the company misclassified salespersons as exempt and that hourly non-exempt employees engaged in unlawful off-the-clock work. Following the successful resolution of the investigation and the rejection by the federal court of the initial class notice to putative class allegations, the case was resolved on very favorable grounds with only 16 of more than 1,600 putative class members opting into the class and receiving payment.
