Abbott defends against claims that premature infant's brain injury was caused by infant formula

Jones Day represented Abbott Laboratories in a case alleging brain injury to a premature infant after being fed at home both liquid and re-constituted powder formula, prepared in the family's kitchen by the parents. Plaintiffs alleged that both products contained the bacteria that produced meningitis in the infant which resulted in severe and permanent brain damage. This case settled on mutually agreeable terms.
