Death row inmate's second petition for habeas corpus reviewed by Sixth Circuit

The Sixth Circuit U.S. Court of Appeals appointed Jones Day lawyers John Q. Lewis and Anne Owings Ford in November 2007 to represent an indigent Ohio death row inmate in his efforts to obtain judicial review of a second petition for habeas corpus. The inmate was convicted of attempted rape, aggravated burglary and aggravated murder and sentenced to death in 1985. The voluminous record has been obtained and reviewed and numerous errors - both at trial and after - have been identified. A briefing schedule has been requested from the Court. Lewis and Ford, who are assisted in this matter by New Lawyer Jeffrey M. Schmitt, recently have had to broaden their representation to include appearing in the Ohio Supreme Court, to fight the State's effort to set an execution date for the inmate despite the pendency of his Sixth Circuit case. It is anticipated that briefing and oral argument in the Sixth Circuit will take place in the second half of 2008.
