Where to file and what to enforce — two critical decisions that are not always so simple. What venue is best for brand owners in the wake of the many circuit splits and recent holdings regarding fee shifting in the patent and trademark office? What about the PTAB — particularly in view of two pending U.S. Supreme Court cases? Are PTAB judgments sticking on appeal, and how are they being handled on remand? Additionally, we will discuss the explosive growth of FinTech (financial technologies) and the re-emergence of patents in the financial services industry, along with the drafting and enforcement considerations to be weighed.

Matthew W. Johnson, Partner, Intellectual Property Practice (Pittsburgh)
Matt is one of the Firm's primary contacts on practice before the USPTO's Patent Trial and Appeal Board, where the patentability of issued patents can be challenged. Currently co-chairing the Firm's PTAB Litigation subpractice and involved in proceedings at the Board, including trials for inter partes review (IPR) and covered business method (CBM) review since the first day of their availability in September 2012, Matt regularly represents clients as both petitioners and patent owners at the Board. He further works as an advocate for clients in appeals from Board proceedings at the Federal Circuit. Matt is the administrator of Jones Day's PTAB Litigation Blog (PTABLitigationBlog.com).
Joshua R. Nightingale, Associate, Intellectual Property Practice (Pittsburgh)
Josh practices all aspects of patent-related work in the electrical and computer areas, including client counseling, patent prosecution, appeals before the Federal Circuit, and U.S. district court litigation. He is also actively involved with the PTAB Litigation group at Jones Day and has represented clients in more than 12 post-grant trials at the USPTO's Patent Trial and Appeal Board. Rich practices all aspects of intellectual property-related work, including client counseling, trademark prosecution, licensing, transaction due diligence, assisting in patent prosecution, supporting appeals before the Federal Circuit, and litigation before U.S. district courts.
