U.S. Steel successfully resolves toxic tort suit involving alleged exposure to benzene and light oil from coke batteries

Plaintiff Mark Lindsley sued Jones Day client, United States Steel Corporation, in its individual capacity and as the general partner of Clairton 1314B Partnership, L.P., along with five other defendants. The plaintiff alleged he contracted aplastic anemia from his exposure to light oil, which contains benzene, while working at the Clairton Works facility near Pittsburgh. The Complaint included claims for ultrahazardous activities, strict negligent products liability, and reckless conduct. The plaintiff sought damages in the nature of medical costs, lost wages and benefits, lost household services, medical monitoring, and pain and suffering, as well as punitive damages. Jones Day pursued extensive discovery of plaintiff's claims and successfully obtained the dismissal of U.S. Steel in its capacity as plaintiff's employer. The Firm then took the lead on behalf of all defendants in negotiating a very favorable, global resolution of all claims. The case was dismissed with prejudice on November 20, 2007.
