Victoria Dorfman's practice focuses on providing legal analysis and strategy, as well as briefing and argument, in complex cases. She has argued before the U.S. Courts of Appeals for the Sixth, Seventh, and Ninth Circuits and has represented clients in the U.S. Supreme Court and in federal and state courts throughout the country. Her areas of experience include:
Jurisdiction and civil procedure
represented a Chinese company in a successful U.S. Supreme Court challenge involving forum non conveniens doctrine
represented Bayer, obtaining dismissal of state law claims based on preemption and standing; currently representing Bayer on appeal in the Second and Federal Circuits
represented Procter & Gamble to obtain discovery pursuant to 28 U.S.C. § 1782 to defend against foreign patent infringement suits
represented Chevron in successfully resisting the government's motion to dismiss on sovereign immunity grounds in a contract dispute and defeating government's assertions of executive privilege
provided legal strategy and advice to Sherwin-Williams, in a nuisance suit based on use of lead paint, on initiation of federal proceedings, which raised abstention and right to jury trial issues and
currently representing a Russian client in an international arbitration that involves jurisdictional issues, including "lois de police."
Antitrust and general commercial litigation
represented Bayer in ciprofloxacin hydrochloride antitrust litigation, dismissing dozens of nationwide antitrust class actions challenging the settlement of patent litigation between branded and generic pharmaceutical companies, as well as in multiple state court proceedings, dismissing class claims and denying class certification; also representing Bayer in antitrust challenges in Wisconsin, California, Tennessee, and Kansas state courts
representing Bayer in an appeal defending a victory of a summary judgment in a vertical price-fixing case and
represented Sherwin-Williams in a public nuisance action brought by the state of Rhode Island, raising issues of joint and several liability and apportionment.
Constitutional litigation, including First Amendment
represented Congressman Boehner in a successful prosecution of private action for violation of federal anti-eavesdropping statute
represented Cooper Tire in an application for TRO at the U.S. Supreme Court to enjoin publication of confidential trade secrets obtained in an uncontested, ex parte proceeding and
currently representing the district attorney's office of Maricopa County (Arizona) in a due process, First Amendment, and equal protection challenge to segregated DUI courts.
International arbitration
currently representing a Russian client in an arbitration brought by a Canadian company in a contractual dispute over diamond mines located in Russia.
Victoria is a native speaker of Russian. She has been active in the American Bar Association and is a cochair of the ABA's Appellate Practice Committee's Publications Subcommittee and is on the editorial board of the ABA Appellate Journal. She has published articles on federal jurisdiction, statutory interpretation, and decisional sequencing as well as on how to succeed in a law firm appellate practice.
