Todd Swatsler has handled complex commercial litigation throughout the country for 30 years. He has particular experience in restructuring litigation, energy matters, the health care industry, and tax disputes. Todd played a key role in the Firm's restructuring efforts on behalf of Chrysler. In 2010, he represented Spansion Japan in asserting claims in the chapter 11 proceedings of its former parent, resulting in a $100 million cash payment to Spansion Japan.
Todd represented AEP in a large power sales contract case in federal court in New York. After a trial and appeal to the Second Circuit (which Todd argued), the case settled with AEP receiving $263 million. Other energy clients have included Cinergy, Columbia Gas, Dayton Power & Light, Duquesne Light Company, FirstEnergy, and Kinder-Morgan. Todd is a member of the Firm's Marcellus/Utica shale litigation team.
Todd has litigated state and federal tax disputes around the country. He tried a landmark case for the Ohio Farm Bureau on the taxability of payments made to a nonprofit corporation in exchange for agreements not to compete. He represented Dell in tax nexus matters nationally and successfully tried the lead case in Ohio on the use of unitary appraisals to value interstate property. Other tax clients include Ameritech, Colgate-Palmolive, Macy's, Sprint, and Verizon.
With respect to health care, Todd has represented Bon Secours Health System, the Guthrie Clinic, Hillenbrand Industries, ProMedica Health System, and SSM Health Care in a variety of disputes.
