Pharmaceutical, Medical Device, and Other Health Care Product Liability Litigation - Overview

Pharmaceutical and medical device manufacturers operate in a challenging – and perhaps, at times, a menacing – litigation environment.  From pre-litigation counseling, through jury trial and, if necessary, appeal, or through creative resolution of cases, Jones Day attorneys have the knowledge to meet manufacturers' needs.

  • Pharmaceutical Litigation .  Mark Herrmann (Chicago), J.C. McElveen (Washington), Dave Alden (Cleveland), David Rutkowski  (Washington), Ed Sebold (Houston) and others currently serve as national counsel for any cases filed against a manufacturer of a prescription antidepressant.  We have also represented clients in DES litigation, and we other more routine pharmaceutical products liability litigation in courts across America.  June Ghezzi  (Chicago) and others represent TAP Pharmaceutical Products Inc. in litigation involving Lupron®, a drug used to treat, among other things, endometriosis.
  • Medical Device Litigation.  Led by Ed Sebold (Houston) and John Lewis (Cleveland), Jones Day serves as international coordinating counsel for all breast implant, penile implant, and anti-reflux device cases filed against a medical device manufacturer.  Mark Herrmann (Chicago) and others played leading roles in the orthopedic bone screw litigation.  We have also represented clients in latex glove litigation (Carrie Hogan (Chicago)), and a manufacturer of thermal control devices (Paul Crist (Cleveland)).
  • Blood and Blood Products Litigation.  In Jones Day's Paris office, Laurent Martinet (Paris) and others have extensive experience in litigation alleging contamination of blood and blood products.
  • Health Care Diagnostic Products Litigation.  Carrie Hogan (Chicago) and Liza Kessler  (Columbus) represent a major pathology (pap smear) diagnostic provider with respect to product liability and professional negligence claims.  We have also represented manufacturers of ultrasound and other noninvasive diagnostic equipment.
