Michael McFalls represents leading companies across a variety of industries before the Federal Trade Commission and Department of Justice in antitrust investigations and litigation. He also counsels these companies on a regular basis and provides strategic advice to litigators.

Since returning to Jones Day from the FTC in 2000, Michael has worked on some of the most challenging mergers and acquisitions in the antitrust world, representing, among others, XM in its combination with Sirius; Abbott Laboratories in its acquisitions of Kos Pharmaceuticals, Therasense, and Knoll AG's pharmaceutical business; Procter & Gamble in its acquisitions of Gillette, Wella, and Clairol; RJR in its combination with Brown & Williamson; and King Pharmaceuticals in its acquisition of Alpharma.

Michael also provides representation before the government and counseling to numerous companies on nonmerger issues, particularly those involving antitrust and intellectual property. He co-coordinates the Firm's practice involving application of antitrust law to issues involving intellectual property and advises pharmaceutical and biotechnology companies on the increasingly complex antitrust issues confronting those companies under U.S. antitrust law. He also counsels companies on the numerous joint venture and standard-setting questions that arise in both high-technology and traditional industries.

Michael's nonmerger work builds on his experience at the FTC from 1997 to 2000, where he was attorney-advisor to Chairman Robert Pitofsky and helped develop the FTC/DOJ "Guidelines for Competitor Collaborations." He has been chairman of the Computer & Internet Committee and co-chair of the Intellectual Property of the ABA Section of Antitrust Law.
