Morgan Hirst represents clients in all aspects of civil litigation and responding to government investigations.
Recently, Morgan has been involved in a number of the Firm's high-profile litigation matters. Morgan was part of the team representing Potash Corporation of Saskatchewan in its successful defense of a $40 billion hostile tender offer from mining giant BHP Billiton, which, over the course of six weeks, included the taking of discovery in the United States, Canada, and Europe and a two-day evidentiary trial. Morgan also was part of the team representing Navistar International in a breach of contract case filed by Ford Motor Company, where Ford sought more than $1 billion in damages. After two years of litigation, the parties publicly announced a settlement whereby Ford agreed to, among other things, make a cash payment to Navistar.
Morgan has substantial experience in representing the Firm's health care clients. He has represented numerous pharmaceutical clients in responding to both federal and state investigations concerning the anti-kickback statute, best pricing rules, and False Claims Act.
Morgan also represents Firm clients in tax litigation matters. Most recently, he obtained summary judgment in a federal tax refund matter in U.S. District Court in Chicago, resulting in a refund to the client of all tax and interest sought.
Morgan has substantial jury trial experience, including second-chairing a two-month jury trial in Illinois state court. He has argued appeals before the Sixth and Seventh Circuits and the Missouri Supreme Court.
