J.C. McElveen represents clients in cases claiming cancer, birth defects, neurological problems, delayed mental development, and other adverse effects, allegedly caused by chemicals, radiation, and drugs. J.C. also has litigated cases under the Occupational Safety and Health Act involving OSHA's Process Safety Management, Lock Out/Tagout, Medical Record Access and Hazard Communication Standards, and the General Duty Clause.
For the last five years, J.C. has represented Wyeth in claims that one of its drugs caused suicidal behavior and claims that the drug caused heart, liver, and kidney problems. Other representations include defense of IBM against allegations that chemical exposures in the workplace caused cancers and birth defects, defense of a major public utility against claims that coal tar waste caused a cluster of childhood cancers, and defense of a major government contractor against claims that radiation exposure caused leukemia.
J.C. is on the editorial board of the scientific journal Human and Ecological Risk Assessment, and he has written many articles and book chapters on epidemiology, risk assessment, reproductive hazards, and occupational safety and health law. He is a member of the American Bar Association's Litigation Section and Torts and Insurance Practice Section, and he serves on the Occupational Safety and Health Committee of the ABA's Labor and Employment Law Section.
