Dana defends against former employee's age discrimination lawsuit

January 2005

Jones Day represented Dana Corp. in a lawsuit brought by a former employee alleging discrimination and spoliation of evidence. A former employee alleged that her demotion and discharge were motivated by age discrimination. The representation involved the investigation of the employee’s claims and taking numerous depositions, including depositions of several treating physicians. Jones Day also dealt with significant evidentiary issues, many of which involved electronic discovery. During the course of the litigation, the plaintiff died and the representation ultimately involved the issues of claim survival.
