Province Healthcare awarded summary judgment in antitrust litigation filed by physician-owned surgery center

December 2004

Jones Day represented Province Healthcare in an antitrust and tortious interference lawsuit brought against Province and its Havasu Regional Medical Center (HRMC) by a physician-owned surgery center in Lake Havasu City, Arizona. Plaintiffs alleged that Province and HRMC threatened the surgery center and recruited physicians to town to harm the surgery center and its physician investors. About seven months after the suit was filed, the antitrust claims were dismissed. The plaintiff filed an amended complaint converting most of the antitrust claims into tortious interference claims. The Court ultimately granted our motion for summary judgment.
