Elena Kaplan advises employers with respect to providing employee benefits and designing compensation structures in compliance with applicable laws, including ERISA and the Internal Revenue Code. She provides advice on all manner of benefits, including health and welfare benefits, qualified retirement plans, nonqualified deferred compensation plans, and severance. She assists employers in all phases of providing benefits from plan design to implementation, ongoing compliance, and plan termination.

Elena has extensive experience advising covered entities regarding the HIPAA Privacy and Security requirements. Recently, she has been assisting employers with addressing the new requirements under health care reform, including updating plans to comply with immediate mandates, analyzing the benefits of grandfathered status, and providing guidance about the new world of providing health benefits under the upcoming "pay or play" rules for employers.

Elena currently serves on the board of governors of the State Bar of Georgia, the board of directors of the Georgia Legal Services Program, and the board of trustees of the Georgia Client Security Fund. She previously served as president of the Young Lawyers Division of the State Bar of Georgia.
