Dan McMillan specializes in complex commercial, business, and construction litigation. He is cochair of Jones Day's multidisciplinary construction practice. He represents owners, design professionals, and contractors in large construction disputes and in negotiating and drafting contracts for construction projects. In addition to construction industry matters, he has handled complex contractual disputes and claims involving federal and state securities laws, RICO statutes, false claims acts, and antitrust laws. Dan has substantial trial, law and motion, and appellate experience. He also has extensive experience with domestic and international ad hoc and administered arbitrations, mediations, and a variety of hybrid alternative dispute resolution mechanisms.

Dan is a member of the Disputes Review Board Foundation, the Association of International Petroleum Negotiators, the American Bar Association Forum on the Construction Industry, and the Forum's Steering Committee for Dispute Avoidance and Resolution. He is on the executive board of the Los Angeles Economic Development Corporation and is a member of its Critical Infrastructure Task Force. He has been an adjunct professor at Loyola Law School, teaching appellate advocacy, and is an instructor for the National Institute of Trial Advocacy, training attorneys on everything from deposition to trial skills. Dan currently serves on the Commission on Judicial Nominees Evaluation or JNE Commission that evaluates judicial candidates and reports to the governor of California.

A frequent speaker and writer on issues of interest to the construction industry and the legal profession, the many publications Dan has authored and coauthored include: "Prequalification of Contractors by State and Local Agencies: Legal Standards and Procedural Traps," 27 Const.
