Coordination of Product Liability Litigation - Overview

Jones Day has served many clients as national or regional coordinating counsel in product liability litigation.   In a very real sense, Jones Day helped to define and refine this role in high stakes litigation where our clients' interests required consistency, coordination, and unremitting dedication.  

Currently, Jones Day serves as national coordinating counsel for a number of clients, including the following matters:

  • Tobacco Litigation.  Led by Paul Crist (Cleveland) and Ted Grossman (Cleveland), Jones Day has served as national coordinating counsel for R.J. Reynolds Tobacco Company since 1985 in personal injury, class action, governmental, medical monitoring, and health care cost recovery cases.
  • Lead-Based Paint and Pigment Litigation.   Since 1987, Jones Day has served as national coordinating counsel for The Sherwin-Williams Company in all lawsuits alleging claims growing out of its prior manufacture and sale of lead-based paint and pigment with Mickey Pohl (Pittsburgh), Chuck Moellenberg (Pittsburgh), and Laura Ellsworth  (Pittsburgh) coordinating the defense.
  • Pharmaceutical and Medical Device Litigation.   Jones Day has served as national or regional coordinating counsel for a variety of pharmaceutical products (including an antidepressant, Lupron®, and DES) and medical devices or products (including latex gloves, breast and penile implants, orthopedic bone screws, and an anti-reflux device).
  • Global Warming Litigation. Jones Day lawyers, including Tom Fennell (Dallas), Mike Rice (Dallas), Kevin Holewinski (Washington), Chuck Moellenberg (Pittsburgh), and Jim Teater (Houston), successfully defended against public nuisance claims brought by the Attorneys General of eight states alleging that carbon dioxide emissions contribute to global warming.  State of Connecticut, et al. v. Sep. 15, 2005).
  • Northridge Earthquake Litigation.    John Majoras (Washington) and Rich Bedell (Cleveland) successfully defended The Lincoln Electric Company in approximately 20 lawsuits filed by building owners and insurers in repair-related and other property claims purportedly discovered after the Northridge earthquake of January 1994.
  • Alcohol Litigation.  Rob Faxon (Cleveland) acting as national counsel to Labatt Canada and Labatt USA in defending claims of advertising to underage drinkers through its marketing programs.
  • Firearms Litigation.  Tom Fennell (Dallas), Mike Rice (Dallas), Mark Hall (Dallas) and others have represented Colt’s Manufacturing Company, Inc. in municipal cost-recovery litigation and other suits seeking to restrict the distribution and sale of firearms.

Jones Day has served as national or regional coordinating counsel in many types of product liability litigation, including tire and silicosis litigation discussed elsewhere.  The geographical reach of our 13 domestic offices, together with excellent relationships with an extensive network of accomplished  local counsel, permits us to meet client needs when and where they arise.
