Consumer Goods Product Liability Litigation - Overview

Jones Day lawyers have vast experience in defending clients in the automobile, auto parts, tire, tobacco, paint and pigment, firearms, cosmetics, alcoholic beverage, and other industries.  Manufacturers in these industries can attest to the serious threat that mass tort litigation presents.

  • Automotive Litigation.   As described in our Transportation Product Liability Litigation practice overview, we have long represented major automobile and at times component parts manufacturers in product liability matters, including airbags, engines, rollover protection, and electronic components.
  • Automobile Tire Litigation.   Hugh Whiting  (Houston) and others recently represented Bridgestone/Firestone in more than 100 class actions filed after the 2000 recall of some 14 million ATX, ATX II and Wilderness tires.
  • Firearms Litigation.   Tom Fennell (Dallas), Mike Rice (Dallas), Mark Hall (Dallas) and others represent Colt's Manufacturing Co. in the nationwide firearms litigation, including a case set for trial in November 2005 in Brooklyn federal court.  Their win in that same court was recognized as one of the Top Defense Wins of 2003 by The National Law Journal
  • Tobacco Litigation.   More than 20 Jones Day lawyers have tried individual, multi-plaintiff, class action and governmental and third-party payor cases to verdict on behalf of R.J. Reynolds Tobacco Co., and have litigated hundreds if not thousands more to successful conclusions.
  • Alcoholic Beverage Litigation.   Rob Faxon (Cleveland) acting as national counsel to Labatt Canada and Labatt USA in defending claims of advertising to underage drinkers through its marketing programs.
  • Other Consumer Goods.   We have also represented clients in food and beverage, home appliances, automatic gate- and door-openers, glass products, awnings and patio enclosures, power tools, pressure washers, propane cylinders, respirators, and recreational products such as outboard motors.

Jones Day also provides its clients with counseling on topics ranging from prevention of product liability risks, to responding to mass torts.  We have advised clients on warnings; marketing; compliance; electronic discovery; document retention; and a host of related issues.   We have also advised clients on federal and state legislative and administrative rulemaking processes, including Congressional hearings, and proceedings before the Consumer Products Safety Commission, Federal Aviation Administration, Food and Drug Administration, Federal Trade Commission, National Transportation Safety Board, Occupational Safety and Health Administration, and other federal and state government agencies.  We also have advised clients in responding to media inquiries in the context of "crisis communications."
