Brian Poissant is a Chair of the Intellectual Property Practice at Jones Day. Prior to joining Jones Day, Brian was Chair of the Litigation Practice at Pennie & Edmonds, where he worked since 1974. He has served as lead trial counsel for major companies in litigation involving patents covering a wide range of subject matters, such as pharmaceutical products, biotechnology products, infant formulas, medical devices, orthopedic devices, nutritional compositions, advanced magnetic materials, plastic compositions, sailboards, fiber-optic connectors, and jet engine fuel controls.

Brian has extensive experience representing companies in all areas of patent law, including patent procurement and portfolio management; patent opinion, licensing, and agreement work; and patent litigation and related appeals to the Court of Appeals for the Federal Circuit for plaintiffs and defendants. He has advised small start-up companies, as well as established companies, with regard to the design, creation, acquisition, management, licensing, and enforcement of patent portfolios.

Brian has appeared as patent trial counsel in federal courts throughout the entire country. He won a judgment of more than $18 million in the U.S. Court of Claims in 1982 against the United States for the former Bendix Corporation on its jet engine fuel control patent, which at the time was one of the largest judgments ever obtained in a patent action. Brian recently tried and won the largest pharmaceutical case ever under the Drug Price Competition and Patent Term Restoration Act of 1984 (the Hatch-Waxman Act). The case proceeded as a multidistrict litigation in the Southern District of New York and involved multiple defendants. Brian's client emerged as the sole winning defendant in this case. He also recently litigated before the U.S. International Trade Commission and obtained a general exclusion order against several foreign companies under six patents relating to advanced magnetic materials.

Brian is a frequent lecturer and has served on many bar association committees dealing with patent litigation and patent law. In addition, he is a former member of the Board of Directors of the New York Intellectual Property Law Association.
