Resident in Shanghai, Benjamin Bai's practice focuses primarily on global patent litigation, spanning the United States through Asia. A native Chinese and an experienced U.S. patent attorney, he concentrates on representing multinational companies in enforcing IP rights in China and defending Chinese companies in U.S. courts in infringement actions. He also coordinates the Firm's China IP practice.
Benjamin's recent representative matters include: acting as lead counsel for multinational companies, as plaintiffs or defendants, in patent infringement suits in China; acting as lead counsel for Nokia in defense of several patent infringement suits brought by Qualcomm in China; acting as lead IP counsel and advisor to a Canadian manufacturer on comprehensive IP strategies for a billion dollar strategic alliance with its Chinese counterpart and negotiating successfully against the Chinese party; advising several Global 500 companies on IP licensing strategies in China and IP strategies for R&D activities in China; defending Chinese companies in patent infringement suits in various U.S. courts; and advising Chinese companies on IP due diligence and building strategic patent portfolios. Representative clients include Abbott, AstraZeneca, Bombardier, Eastman Chemical Company, General Motors, GSK, Nantong Huasheng Plastic Products Co., Nokia, Pfizer, Purdue Pharma, Sinochem International, and Ventec Electronics.
Benjamin is a prolific writer and frequent speaker on IP issues. He has been an invited speaker on China IP issues around the world and has lectured extensively in the U.S., Europe, and China. He also has written numerous articles on IP protection in China and has more than a dozen scientific publications to his credit.
