Copyrights & Trademarks - Overview

The Copyrights & Trademarks Practice at Jones Day provides comprehensive legal services on an international basis in the areas of trademarks, unfair competition, false advertising, the internet, trade secrets, and copyright laws. Our experience extends from the creation, maintenance, and exploitation of trademark, domain name, and copyright rights to their protection in worldwide competition against infringement, misappropriation, deceptive trade practices, and counterfeiting. This practice also audits intellectual property assets in the context of due diligence required for sale, acquisition, and securitization purposes.

With more than 300 intellectual property lawyers worldwide, Jones Day has one of the largest such practices of any firm and offers clients exceptional access to lawyers and offices around the world. In the U.S., practice lawyers are resident in the East (New York; Washington, D.C.; Pittsburgh; Atlanta), in the Midwest (Cleveland, Columbus, Chicago), in the Southwest (Dallas and Houston), and in the West (San Diego, Irvine, Los Angeles, Menlo Park, and San Francisco). Additionally, the practice has a strong presence in Europe and Asia, with practicing trademark attorneys in London, Frankfurt, Munich, Paris, Brussels, Tokyo, Shanghai, and Taipei. Recent additions of the trademark practices of firms such as Lyon & Lyon and Pennie & Edmonds in the U.S. and Gouldens in the U.K. have enhanced the already substantial trademark capabilities of our practice.

Our lawyers provide practical advice and counsel to companies in selecting, clearing, and protecting trade dress, trademarks, domain names, and copyrights on a global basis. We cover all aspects of the field, from devising and implementing global filing strategies to conducting searches, rendering availability opinions, and filing trademark applications in the U.S. Patent and Trademark Office, the European Community Trademark Office, and virtually every jurisdiction worldwide; at least one trademark registration is issued every day to a Jones Day client. The practice maintains many thousands of registered trademarks and copyrights worldwide on behalf of our various clients.

Jones Day represents a wide variety of clients in all aspects of the enforcement of their intellectual property rights in federal and state courts in the U.S. and in courts around the world, as well as in administrative agencies such as the U.S. Patent and Trademark Office, the European Community Trademark Office, and the International Trade Commission. But the practice's experience goes well beyond standard trademark infringement actions. Our attorneys handle cases that address developing areas of law such as protection of product configuration and trade dress, functionality, survey evidence, false advertising, fair use, and dilution. The practice has extensive experience in pursuing manufacturers and distributors of counterfeit goods throughout the world, and members of the practice work closely with customs and law enforcement officials as well as private investigators.

Jones Day lawyers have represented both electronics manufacturers and consumer products companies in matters relating to copyright protection of software. Copyright litigation often consists of smaller cases in which Jones Day lawyers seek to enjoin local copiers of materials such as T-shirt designs, prerecorded cassette tapes or CDs, posters, and other protected works.
